No. Below are some areas to consider:

Financial Stability
1. Does the company have a strong rating and financial size with A.M. Best & Co.?
2. Is the company’s policy admitted in California? If not, this policy may be subject to limited financial solvency regulation and may not participate in any state insurance guaranty funds, which provide limited claims reimbursement for policyholders of insolvent carriers. Therefore, using a carrier operating under surplus lines laws could result in financial exposure to you. A state tax also applies to surplus lines policies.

Claims Processing
Does the company respond promptly, appoint qualified defense counsel when necessary and actively pursue a fair and speedy resolution?

Comprehensive Policy
Does the policy'

Law practices vary in exposure and coverage needs. Each law firm is unique. A number of factors; including limit of liability, deductible, years in private practice, area of practice and claims history; are used to determine a quote.

It is important when comparing premiums to also compare coverage. Does the policy exclude any portion of your practice? The most expensive policy is the policy that does not respond to your claim because coverage is excluded.

Yes, it is highly recommended. Many potential clients, like mortgage companies and title companies, require proof of professional liability insurance before working with a lawyer.

Statistics show around five percent of lawyers will have a professional liability claim. Even if you have not made a mistake, a client may file a claim against your firm. In those instances a professional liability insurance policy may offset the expenses you incur. Defense costs can get expensive. Every law firm should protect their assets by carrying a comprehensive professional liability insurance policy written through a financially stable carrier.

To determine the deductible for your firm, consider how much you can afford to pay. While a higher deductible will lower the premium, the premium savings may not be cost-effective in the long run if paying a high deductible creates a financial hardship for your firm.

Some Insurers offer different deductible options. Most companies offer Loss and Defense per claim deductibles, where the firm pays the deductible once expenses and/or damages are incurred. A few companies also offer Loss Only per claim deductibles, where the firm pays the deductible once damages are incurred no deductible applies to claim expenses. Aggregate deductibles may be available; however, this option is only attractive if your firm has a high deductible and/or will experience more than one claim during a policy period.

Professional Liability insurance is an insurance policy that responds to claims first made against an Insured and reported to the company during the policy period arising out of any negligent act, error or omissions in the rendering or failure to render professional services.

Professional Liability Insurance may also be referred to as ‘errors and omissions’, ‘E&O’ or ‘Malpractice’ insurance.

Each law firm is unique with specific coverage needs. The most important question is, ‘Does my policy exclude any portion of my practice?’. The most expensive policy is the policy that does not respond to your claim.

Most professional liability insurance policies offer an ‘Each Claim’ and an ‘Aggregate’ limit of liability. The ‘Each Claim’ limit of liability is the maximum available for a single claim. The ‘Aggregate’ limit of liability is the maximum available for a single policy period.

To determine the limit of liability for your firm, we suggest the following:

First, determine your firm’s worst possible loss scenario by:

1. Estimating the damages if your biggest client made a successful claim against you, then

2. Double that number for claim expenses.

Second, consider what your firm can afford. Discuss different limits of liability options with your agent.
